Terms of Service

Best Practice (youbestpractice.com)
Operated by YOUBESTPRACTICE LLC, a Washington limited liability company

Version: Terms v1.4 (2026-10-11)

Effective date: October 13, 2026

Please read this first

These Terms are a contract between you and YOUBESTPRACTICE LLC. A few parts matter most, so here they are in plain words:

1. Who we are and what these Terms cover

1.1 "We," "us" and "our" mean YOUBESTPRACTICE LLC. Our mailing address is PO Box 1386, South Bend, WA 98586. "You" means the person using Best Practice.

1.2 These Terms apply to everything we offer under the Best Practice name: the website youbestpractice.com, the free 50-question practice test, our exam-prep products, our clock-hour courses, the AI study assistant, our emails, and the software that runs all of it (together, "Best Practice").

1.3 These Terms bind every user, including people who only take the free 50-question practice test.

1.4 Whose clock. Every date and deadline in these Terms, the Enrollment Agreement and the Refund and Cancellation Policy, including every refund window and every access period, runs on Pacific Time (Washington time, America/Los_Angeles). A day ends at 11:59 PM Pacific Time. A refund request counts as made when our email system receives it or, by mail, on its postmark date.

2. Agreeing to these Terms

2.1 You agree to these Terms by checking the box that says "I agree to the Terms of Service" when you create an account, when you enter your email to unlock your free-test results, or when you buy something. The box is never checked for you. If you don't agree, please don't use Best Practice.

2.2 We keep a record of each agreement: which version of these Terms you agreed to, when, and the IP address you agreed from.

2.3 These documents are part of these Terms:

3. Who can use Best Practice

3.1 You must be at least 18 years old.

3.2 Give us accurate information and keep it current. For clock-hour courses, your name and contact details must be your own and must match your identity, because Washington's rules require them on your student record and certificate. It's your job to choose the courses your license actually needs and to give us your license number and legal name exactly as DOL has them. If wrong information from you delays your credit, we'll fix it as fast as we can, but we aren't responsible for DOL late fees or license-status changes it causes.

3.3 One account per person. You may not share your account or sign-in, and you're responsible for what happens under your account. Tell us right away at support@youbestpractice.com if you think someone else has used it.

4. What we offer

4.1 The free 50-question practice test. A sample of our exam prep. You can take it without an account. To see your topic breakdown and the explanations, you give us your email and agree to these Terms.

4.2 Exam prep. Our question bank, the diagnostic exam, practice and simulated exams, readiness estimates, the AI study assistant and links to our videos. Exam prep is study material. It does not award clock hours, and the Washington State Department of Licensing ("DOL") does not approve it. Exam prep is sold three ways: national exam prep; national exam prep with the Washington State add-on, bought together in one checkout (the add-on isn't sold on its own); or Washington only, which covers the Washington State questions and not the national ones. Diagnostic and practice tests draw only from what you bought.

4.3 Clock-hour courses. Courses that count toward Washington real estate licensing or renewal. We offer one only while DOL has approved the school, the course and the instructor. You earn clock hours only by meeting every completion requirement in your Enrollment Agreement. We can't award hours for unfinished work, and we can't change DOL's rules.

4.4 The AI study assistant. See Section 11.

5. Education only; no guarantees

5.1 Best Practice is education. We work hard to make it accurate and useful, but we do not promise that you will pass any exam, get or keep a license, or meet any licensing deadline. Whether you pass is up to you and the exam; whether you get a license is up to DOL. DOL decides who gets a license, including after a background check. A criminal history can affect whether you're licensed, so if you have one, ask DOL before you buy.

5.2 We don't offer a pass guarantee or a money-back-if-you-fail promise. We also don't promise a job, a sponsoring broker or employment of any kind, and we don't promise that our clock hours will be accepted by another state or another school. Our clock-hour courses are approved by Washington's DOL for Washington licensing.

5.3 Nothing on Best Practice is legal, tax, lending or transaction advice. For a real transaction, talk to your designated broker or a qualified professional.

5.4 Laws, rules and exam outlines change. Our content reflects our understanding as of when we published it. We update approved courses as Washington's rules require and keep exam prep current as quickly as we reasonably can.

6. Access periods

6.1 Exam prep: 6 months from the date you buy it, whichever way you buy it. The Washington State add-on doesn't start its own clock: its access ends on the same date as the national exam prep order it was bought with.

6.2 Exam prep can't be extended. Your access ends 6 months after you buy it.

6.3 Clock-hour courses: your access to a course begins the first time you launch it and ends 6 months later, whether or not you've finished. Buying a course doesn't start the clock. You can buy one optional extension, 90 more days for $25, once per enrollment, at any time before your access ends; there are no other extensions. If your access ends before you finish, you'll need to enroll again to keep going. The Enrollment Agreement explains what carries over.

6.4 Your login: your login stays active for 5 years after your most recent purchase or course completion, whichever is later, even after your course or exam-prep access has ended, so you can reach your records and certificates.

6.5 Your records: we keep each clock-hour student's record for 5 years, as Washington law requires (WAC 308-124H-935). During that time you can request a copy of your record and a duplicate certificate online, free.

7. Prices and payment

7.1 Prices are shown at checkout in U.S. dollars. Taxes are added where the law requires.

7.2 Stripe processes every payment. When you buy, you authorize the charge. Your card number never reaches our servers.

7.3 If a price is shown wrong because of an obvious error, we may cancel the order and refund you in full, even after you've paid.

7.4 Promotional codes are good only on their stated terms, can't be exchanged for cash, and can't be combined unless the offer says so. We don't adjust the price of a past purchase when a price drops or a sale starts later, and a promotional code can't be added after checkout.

7.5 We don't charge a registration fee or any other fee besides the price of what you buy (and the optional clock-hour course extension in 6.3).

8. Refunds

Refunds follow our Refund and Cancellation Policy. For clock-hour courses, the Enrollment Agreement repeats the refund rules for that course.

9. Your license to use Best Practice

9.1 What you get. We give you a personal, limited, non-exclusive, non-transferable, revocable license to use Best Practice, including its software, content and videos, for your own study during your access period. This license is the only right you get in our software; there is no separate software license agreement.

9.2 What we keep. We (or our licensors) own Best Practice: the questions, answers, explanations, videos, scripts, course materials, the AI assistant's materials, the software, and our name and logo. They're protected by copyright and other laws. Everything not expressly given to you here is kept by us.

9.3 What you may not do with the software. You may not copy, modify, decompile, reverse engineer or try to extract the source code of our software (except where the law allows it despite this rule), rent or resell access, remove notices, or build a competing product from it.

9.4 Feedback. If you send us suggestions or report a problem with a question, we may use what you send without paying you or owing you anything.

Reviews and testimonials. If you send us a review or a testimonial, we'll publish your words, name or picture only with your permission, and only as you gave them (we may shorten them without changing their meaning). You can ask us to take it down at any time, and we will.

9.5 Changes to the platform. We may change, add or remove features. If we take away something central to a product you paid for before your access ends, the Refund and Cancellation Policy explains your options.

10. Rules you agree to follow

10.1 Protect the question bank and our materials. You may not:

10.2 Do your own work. You may not let anyone else use your account, take a test, answer an identity check or complete course work for you, and you may not do any of those things for someone else.

10.3 Exam integrity. We never ask what was on your licensing exam. Please don't tell us or other students. Our questions are written from the published exam content outlines, Washington statutes and rules, and our own teaching materials.

10.4 Play fair. Don't break the law, harass anyone, upload anything harmful, or interfere with Best Practice or other users.

10.5 What happens if you break these rules. We can suspend or end your access without a refund, and we won't certify any course completion obtained by breaking them. Where the law requires, we may report course-work fraud to DOL.

11. The AI study assistant

11.1 The study assistant explains concepts from our own materials and cites its sources. It can still be wrong. Check anything important against the cited source or ask your instructor.

11.2 It is not legal, tax, lending or transaction advice, and it is not your instructor. In a clock-hour course, your instructor is always available through "Ask your instructor."

11.3 It doesn't answer questions during a quiz or a simulated exam.

11.4 In clock-hour courses, time spent with the study assistant doesn't count toward your clock hours unless DOL confirms it can.

11.5 What you ask the assistant is kept and used as our Privacy Policy describes.

12. Copyright complaints

If you believe something on Best Practice infringes your copyright, email compliance@youbestpractice.com or write to us at the mailing address in Section 1, with: your contact information; a description of the work; where the material appears on Best Practice; a statement that you believe in good faith the use isn't authorized; a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or may act for the owner; and your physical or electronic signature.

13. Electronic communications and signatures

13.1 You agree that we can give you notices, agreements, receipts and records electronically, by email to your account address or in your account. They count as "in writing."

13.2 Checking a box, clicking a button or typing your name to agree is your electronic signature, and it's as binding as a handwritten one.

13.3 To get or keep our electronic records you need a current web browser and an email account. You can ask for a paper copy of any agreement or record at support@youbestpractice.com, free. You can withdraw this consent by closing your account, but we can't run courses without it.

13.4 We send account and course emails (receipts, results, deadlines, required notices) to everyone. Study tips and news go only to people who opt in, and every one of those emails has an unsubscribe link.

14. Other services and sites

Best Practice links to YouTube and other sites we don't control, and uses service providers such as Stripe for payments. Their own terms and privacy policies apply when you use them. We aren't responsible for them.

15. Ending your use

15.1 You can stop using Best Practice and close your account at any time by emailing support@youbestpractice.com. Refunds, if any, follow the Refund and Cancellation Policy.

15.2 We can suspend or end your access if you break these Terms, if the law requires it, or if we stop offering Best Practice. If we stop offering a product you paid for before your access ends, for a reason other than your breach, the Refund and Cancellation Policy applies.

15.3 Even after your access ends, we keep the records the law requires, and Sections 5, 9.2, 9.3, 10, 12, 16, 17, 18, 19, 20 and 22 keep applying.

16. Disclaimers

16.1 Best Practice is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties not stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

16.2 We don't promise Best Practice will always be available, uninterrupted or error-free, or that every question and explanation is free of mistakes. If you find an error, please report it; we fix confirmed errors.

16.3 Nothing in this section limits any promise we make in the Enrollment Agreement about awarding clock hours you actually complete, or any right Washington law doesn't allow us to take away.

17. Limits on our liability

17.1 Cap. To the extent the law allows, our total liability to you for all claims of any kind about Best Practice is limited to the greater of (a) the amount you actually paid us for the specific course or product the claim concerns, or (b) $100. This cap applies to everyone, including anyone who uses Best Practice for free.

17.2 The cap is a ceiling, not a payment or a refund. The cap in 17.1 is the most a court or arbitrator could award you against us. It is not an amount we owe or pay you, and it does not give you a right to a refund. Refunds are governed only by our Refund and Cancellation Policy.

17.3 Damages we don't cover. To the extent the law allows, and whether or not you've paid us anything, we are not liable for any indirect, incidental, special or consequential damages, including damages from:

17.4 What these limits don't cover. These limits do not apply to:

18. Your responsibility for your own conduct (indemnity)

18.1 You agree to indemnify and hold harmless YOUBESTPRACTICE LLC, Shannon Frame, and the company's members, managers, employees, instructors, contractors and successors (the "Best Practice parties") from claims brought by third parties (people or organizations other than you and us), and from the resulting losses, damages, settlements and reasonable costs, including reasonable attorney fees, to the extent the claim arises from your own:

18.2 This covers only your own acts. It does not cover any part of a claim caused by the negligence or misconduct of any Best Practice party.

18.3 We'll tell you promptly about a claim covered by this section, and we won't settle it in a way that admits fault for you without your consent.

19. Resolving disputes

Please read this section carefully. It affects how disputes between you and us are resolved, and it waives class actions.

19.1 What this covers. "Dispute" means any claim or disagreement between you and us about Best Practice, these Terms, the Enrollment Agreement or any purchase, whether it arises in contract, under a statute or otherwise, and whether it arose before or after you agreed to these Terms.

19.2 Step 1: 60 days of informal negotiation first (required, and binding on both of us).

19.3 Step 2: binding individual arbitration.

19.4 Small claims court, if either of us prefers. Small claims court is an option, not a required step. After the 60-day negotiation, either of us may bring an individual claim in a small claims court of competent jurisdiction instead of arbitration, as long as the claim stays in that court and is pursued only for the individual party. (This matches the AAA Consumer Rules' small claims option, Rule R-9.) If a small claims case is transferred, removed or appealed to a court that isn't a small claims court, it goes to arbitration under 19.3 instead, unless the law requires otherwise.

19.5 Mass arbitration: staged batches.

19.6 No class or representative actions. You and we each bring claims only individually, never as a plaintiff or class member in any class, collective, consolidated or representative action or arbitration. The arbitrator may not consolidate claims of different people or award relief to anyone but the individual parties, except as the mass-arbitration procedures in 19.5 allow for administration. If a court finally decides that this waiver can't be enforced for a particular claim or remedy, that claim or remedy is severed and decided by a court (Section 20), never in a class arbitration; all other claims stay in individual arbitration, and the court case waits until the arbitration ends.

19.7 Who decides what. A court, not the arbitrator, decides any question about whether Section 19.6 (the class waiver), Section 19.5 (staged batches) or this agreement to arbitrate is valid, enforceable, revocable or applies to a dispute. This controls over any AAA rule that would give those questions to the arbitrator. The arbitrator decides everything else.

19.8 Your right to opt out of arbitration. You can opt out of arbitration (19.3 and 19.5 to 19.7) within 30 days after you first agree to these Terms by emailing compliance@youbestpractice.com from your account email with your name and the words "I opt out of arbitration." If you opt out, disputes not resolved in the 60-day negotiation go to court under Section 20 (or, if either of us prefers, to small claims court), and everything else in these Terms still applies, including the 60-day negotiation first. Opting out doesn't affect anything else, and an earlier opt-out stays in effect when these Terms change.

19.9 What this section never limits.

19.10 If we change this section. If we make a material change to Section 19, it won't apply to a dispute that either of us gave notice of before the change took effect. You can reject the change by emailing compliance@youbestpractice.com within 30 days after we notify you of it; then the version you last agreed to keeps applying to you.

20. Governing law and courts

Washington law governs these Terms, without regard to conflict-of-law rules, and the Federal Arbitration Act governs Section 19. Any dispute that goes to court (because it isn't arbitrated) is heard in the state courts in Pacific County, Washington, or the United States District Court for the Western District of Washington, and you and we agree to those courts' jurisdiction, except where the law gives you the right to sue where you live.

21. Changes to these Terms

We may update these Terms. We'll post the new version with a new effective date and version number, and email account holders about any material change at least 30 days before it takes effect. A material change applies to you when you next agree (by checking the box at your next purchase or sign-in), or after the 30 days if you keep using Best Practice. Changes never apply to a purchase made before them in a way that takes away access or refund rights you already had. Section 19.10 governs changes to the dispute section.

22. General

22.1 Whole agreement. These Terms and the documents in Section 2.3 are the whole agreement between you and us about Best Practice.

22.2 Severability. If a court finds part of these Terms unenforceable, the rest stays in effect, and the unenforceable part is limited as little as needed, except that Sections 19.5 and 19.6 are handled as they say.

22.3 No waiver. If we don't enforce a part of these Terms right away, we can still enforce it later.

22.4 Assignment. You can't transfer your account or these Terms. We may transfer these Terms to a successor that takes over Best Practice, which must honor them.

22.5 Things outside our control. We aren't responsible for delays or failures caused by events we can't reasonably control, such as outages at our service providers, internet failures, natural disasters or government action. This doesn't take away refund rights under the Refund and Cancellation Policy or a clock-hour student's rights if the school closes.

22.6 Notices to us. Disputes: compliance@youbestpractice.com. Everything else: support@youbestpractice.com, or by mail to the address in Section 1.

22.7 Headings are for convenience only.
